Amendments to the Law on Employment of Persons

In the “Official Gazette of the Republic of North Macedonia” No. 148/2026 of July 6, 2026, the Law on Amendments to the Law on Employment of Persons was published, which introduces several significant changes in the manner and conditions for employment:

• Extension of the employment period – employment of up to 180 days in a calendar year is allowed, which represents an increase in the maximum employment period.

• A larger number of employees in the catering industry – employers with up to 100 employees can hire up to 10 people, while employers with more than 100 employees are allowed to hire up to 15% of the total number of employees.

• Mandatory reporting before starting work – the hired person must be reported before the start of the shift. This provision abandons the previous legal solution of reporting at certain hours during the day.

• Changes in inspection supervision – the deadline for eliminating the identified irregularities is no longer solely determined, but is determined by the inspector in accordance with the nature and severity of the irregularity and the time required for its elimination.

• Right to appeal – an appeal can be filed against the inspector’s decision within 15 days of receiving the decision, whereby the appeal does not postpone the execution of the decision.

• Misdemeanor liability – sanctions are also foreseen for failure to act on the inspector’s orders to eliminate the identified irregularities.

The amendments allow for greater flexibility in hiring people for seasonal and occasional work, especially in the catering industry. At the same time, the obligation for timely registration of hired people is tightened and inspection supervision is strengthened, which will contribute to greater control and prevention of any abuse of the rights of hired people by employers.
