Non-working Sunday

As of January 1, 2022, the amendments to the Law on Labor Relations published on December 21, 2021 in the “Official Gazette of the Republic of North Macedonia” no. 288/21.

The amendments to the Law on Labor Relations envisage Sunday to be a day of weekly rest, unlike the previous legal solution when the day of weekly rest could be another day of the week.

The amendments to the Law provide for exceptions to this rule, for workers at employers in activities where the work process is of such a nature that it can not be interrupted due to the technical-technological process and the need for continuity in work, a day off may be another day of the week.

With the new legal solution, the employee, in addition to the right to a salary supplement for work on Sunday, has the right to use weekly leave for the next 7 days. The weekly salary supplement is at least 50% for each hour spent at work, unless a higher amount of the supplement is determined by law and collective agreement.

For employers that do not comply with the new legal provisions, the fines are defined in monetary value and a ban on doing business depending on the type of violation are provided.

The Labor Law stipulates that the employees of the employers from retail and wholesale trade use the weekly leave in accordance with the Law on Trade, hence, in order to harmonize the legal provisions, the Law on Trade has been harmonized, for which on 27.12.2021 in the “Official Gazette of the Republic of North Macedonia” no. 295/21 the Amendments to the Law on Trade were published.
